Terms of Delivery
These terms of delivery apply to all quotations, orders and deliveries by Nibro BV, Nijverheidsweg 13a, 5061 KK Oisterwijk, the Netherlands, registered with the Dutch Chamber of Commerce under number 66552109.
1. General
These terms apply to every offer and every agreement between Nibro BV and a customer, unless deviations have been expressly agreed in writing.
2. Quotations and orders
All quotations are without obligation and valid for the period stated in the quotation. An agreement is concluded when Nibro BV has confirmed the order in writing or has started its execution.
3. Prices
Prices are in euros, exclusive of VAT, unless stated otherwise. Nibro BV reserves the right to adjust prices if cost-determining factors change significantly.
4. Delivery times and dispatch
Products in stock that are ordered on working days before 13:00 are in principle dispatched the same day. Stated delivery times are indicative.
5. Delivery and shipping costs
Delivery to addresses in the Netherlands, Belgium and Germany is free of charge above the minimum order value stated in the quotation or order confirmation.
6. Custom-made products
Custom-made clamps and special sizes are produced on the basis of specifications supplied by the customer.
7. Retention of title
All delivered goods remain the property of Nibro BV until the customer has paid all amounts due under the agreement in full.
8. Inspection and complaints
The customer must inspect the goods immediately upon delivery. Visible defects or shortages must be reported in writing within 8 days of delivery.
9. Returns
Returns are only accepted after prior written approval by Nibro BV. Custom-made products are excluded from return.
10. Warranty and liability
Nibro BV guarantees that the delivered products meet the agreed specifications. Liability is limited to repair, replacement, or crediting of the invoice value.
11. Payment
Unless agreed otherwise, invoices must be paid within 30 days of the invoice date, without discount or set-off.
12. Applicable law and disputes
All agreements with Nibro BV are governed by Dutch law.
